<div><strong>Colorado ASSET</strong></div>

Yesterday I had the pleasure of attending the bill signing for one of my bills that passed early on in the session,<strong> Colorado ASSET (SB13-033)</strong>.  The Student Success Center at Metro State University of Denver was packed with students and those who have worked to pass this legislation over the past 10 years as Governor Hickenlooper signed it into law.  This measure will ensure that all aspiring students that graduate from Colorado high schools are eligible for in-state tuition.</div>

<div><strong>Election Reform </strong></div>
<div></div>
<div>We have also been busy passing legislation that will make exercising our constitutional right to vote easier and more accessible for everyone, as well as decrease voter suppression. The<strong> Voter Modernization Act (HB13-1303)</strong> will streamline the elections process in our state. In the 2012 election, 30 percent of eligible voters did not vote. This means there is much room for improvement in our system.  This legislation will provide uniformity in voting across Colorado, reducing confusion.</div>

<div>These efforts will reduce the number of provisional ballots needed and reduce costs associated with election judges, as fewer will be needed. It also extends the voter registration period up until election day. It will also automate the Statewide Voter Registration System (SCORE System) and provide real-time updates in every county. This means daily updates including information such as felony convictions and deaths. The current system only requires monthly updates.</div>

<div>All of these changes will actually save Colorado hundreds of thousands of dollars in the long run. Savings in the process of provisional ballots alone would be close to or exceed $212,000 statewide. This bill is a significant bi-partisan achievement that was developed along with the Colorado County Clerk&#8217;s Association and will be a great improvement to the electoral system in our state.</div>

				<content:encoded><![CDATA[<p>HB13-1255 passed unanimously out of the House of Representatives today. This bill states that Internet Protocol (IP)-enabled services should not be subject to outdated rules stemming from the era of monopoly telephone companies. It clarifies that IP-enabled services do not fall under the jurisdiction of the Public Utility Commission (PUC) for setting prices, terms and conditions or service standards. The legislation does not impact any existing state and federal requirements on IP-enabled services.  For example, the bill ensures continued PUC oversight over 911 calls.</p>
<p>This sends a message to the rest of the country that Colorado welcomes continued investment, new high-tech companies and job growth from rapidly evolving internet technologies.  It also updates statues that have not changed since 1995 to reflect today&#8217;s technologies.</p>
<p>Internet protocol is the language of the internet.  It is the &#8220;packets of data that deliver voice, video or data over the web.  IP-enabled services bring us many benefits that are used every day, including Wi-Fi and the ability to videoconference with family and friends across the globe.</p>
<p>This bill will ensure that Colorado is not burdened by unnecessary regulations that deter investment, innovation and increased competition for consumers.</p>

				<content:encoded><![CDATA[<p>HB13-1285 passed out of the House of Representatives today with a 35-28 vote.  This bill will commission a study to determine if disparities exist between the participation of underutilized businesses, which include ethnic minorities, women, veterans and persons with disabilities.  All businesses that are owned and operated by these groups are a critical component of economic development and job creation in our state.  Colorado has an obligation ensure a level playing field so that all qualified entities can compete for state business.</p>
<p><b></b>We should encourage fair business practices to ensure that an equitable state contract procurement process exists. We need to expand our innovative approaches to encourage the growth of minority, women, veterans and disabled persons enterprises. The state of Colorado has never in its history performed a disparity study.  Colorado is a state that blazes a trail of innovation, and to continue to do so we need diversity and innovation in the market place. This study will determine if there are inequities in the state procurement process that we must then address with future legislation to continue to move forward.</p>
<p>Representative Joe Salazar and myself have worked with the Colorado Department of Personnel &amp; Administration as well as more than a dozen other organizations throughout Colorado to develop this piece of legislation and will continue to partner with them on this important study.</p>

				<content:encoded><![CDATA[<p>HB 13-1230, concerning compensation for persons wrongly incarcerated, passed out of the House of Representatives with a 60-2 vote.  This bill would provide compensation and services for those who have been wrongfully convicted of felonies and have served time in jail, prison or juvenile placement. In order to be eligible, the person must be exonerated and prove actual innocence. To help those who have wrongfully served time in prison, the following compensation is provided to help them start a new life:</p>
<p>·      Monetary compensation in the amount of 70,000 dollars is given for each year wrongfully served.  An additional 50,000 dollars is granted for each year that a person awaited execution.  Finally, for each year someone served on parole, probation, or as a registered sex offender for a wrongful conviction they will receive 25,000 dollars.</p>
<p>·      Tuition waivers at state institutions of higher education, including four-year institutions and two-year technical schools.</p>
<p>·      Compensation for child support payments owed by the exonerated person that became due during his or her incarceration, and interest on child support arrearages that accrued during his or her incarceration but which have not been paid.</p>
<p>·      Reasonable attorney fees.</p>
<p>·      The amount of any fine, penalty, court costs, or restitution imposed upon and paid by the exonerated person as a result of his or her wrongful conviction or adjudication.</p>
<p>This compensation attempts right a wrong made by the state by providing tools to those wrongfully convicted and help them to integrate back into society.</p>

				<content:encoded><![CDATA[<p><strong>HOA Reform Package Introduced</strong></p>
<p>This month we passed the halfway mark of this year&#8217;s session.  This month I have worked with a group of my fellow legislators to introduce a package of Home Owner&#8217;s Association (HOA) reform bills.  This is a true concern for my constituents. We have worked with many stakeholders to ensure that these are common-sense solutions that will balance the interests of HOAs with homeowners&#8217; rights.</p>
<p>I am carrying two of the four bills in this package. The first of these will regulate community managers.  Currently, HOAs and their community association managers are not required to be licensed.  With this piece of legislation, HOA managers will be licensed under the Division of Real Estate within the Department of Regulatory Agencies. In order to get this license, a person will have to pass an exam showing they have a working knowledge of standard budgeting practices and laws concerning consumer protection.</p>
<p>The second bill that I am carrying deals with the debt collection process by requiring HOAs to establish consistent debt collection policies as it relates to unpaid assessments. Under this act, HOAs will be required to provide clear information abouttheir unpaid assessments and offer payment plans to struggling homeowners.</p>

<p>HOAs will not be allowed to turn over delinquent amounts to a collection agency or an attorney for action until a homeowner has been given six months to pay off the assessment amount. Homeowners will be required to stay current on regular assessments as they pay off their payment plan. If a homeowner defaults in their payment plan, the HOA will be able to take immediate collection action.</p>
